NW strives to have third-party http access network connectivity availability 99% of the time ( “website availability” ).

Technical support by NW is limited to technical characteristics of the server and the services it offers. It is the User's responsibility to keep backup copies of their files, in Linux servers there is a backup system through the control panel, in the event of a fortuitous loss of total or partial information on the servers. The user will address the situation by restoring their backups.
It is the user's responsibility to make frequent backups of all the information stored in their hosting account: web page, databases, email accounts, applications, etc.

NW believes in free speech; however, any content (written, visual, or implied) in the following areas will not be tolerated and sets grounds for immediate suspension of service: racism or bias due to color, creed, or belief; any violent/malicious/obscene written, visual or implied content. We will not tolerate any type of hate site, including terrorism related sites, on our network.
If we receive notice of any hate sites hosted on our network the customer hosting such material will be notified immediately. You will be required to remove the content within a certain period of time or face suspension and/or termination of your account.
We prefer that you self-regulate the content of your account and be aware of and responsible for what your site publicly provides. Even if other users have access to your account, you are responsible for their actions. The resources and time required to regulate our servers by checking each site individually, which are constantly increasing and modifying their content, is impossible.
However, if netwoods.net becomes aware of any questionable content on hosted sites, we will immediately address it directly with you to seek an amicable resolution. Content that violates copyright is also not acceptable.

The servers represented by Netwoods may be used for lawful purposes only. Transmission, storage, transmission of any information, data or material that violates any regulation or law is prohibited. This includes, but is not limited to: copyright, trademark, trade secret or any other intellectual property used without proper authorization, restricted drug sales, and material that is obscene, defamatory, constitutes an illegal matter, or violation of export control laws the laws of the state of florida. Spam, or the sending of unsolicited email, even in small amounts, from or through a Netwoods server, or using an email address that is maintained on Netwoods equipment, is STRICTLY prohibited. Netwoods will be the sole arbitrator as to what constitutes a violation of the provisions. If you engage in any of the above activities, using the services of another provider's ISP or IP, but routing activities through Netwoods servers such as mail delivery, or mail for replies, it is a violation. Violators will be penalized a minimum of $200.00 and face immediate suspension. See our NO SPAM policies for more details.
An email is "spam" IF: (1) the personal identity of the recipients and the context are irrelevant because the message is equally applicable to many other potential recipients; AND (2) the recipient has not verifiably knowingly, explicitly and even revocably accepted permission for it to be sent to you; And (3) the transmission and reception of the message appears to the receiver to give a disproportionate advantage to the sender.
You will be cited with “UCE/UBE Abuse” if you send any email to people who have not specifically asked to receive email from you. The origin of the sending of said email is irrelevant. Once abuse is confirmed by any Netwoods client engaging in this practice, their service will be suspended. The number of messages allowed to send per hour, per domain is 350 messages. You must not try to hide, coerce or misrepresent the sender of the email and the site the email is from.

All email-based subscriptions must have valid, non-electronic contact information for the issuing organization in the body of each email including either a phone number or physical mailing address.
A mass mail must be requested, defining that the sender has an existing or probable relationship with the recipient of the mail and the recipients have not requested not to receive future mail from the sender. Documentation of the relationship between the sender and receiver must be available to AOL upon request.
Prohibited uses of the NW network system and services with respect to Spam
Sending of Unsolicited Mass Email (“UBE”, “spam”).
The sending of any form of unsolicited bulk mail through Netwoods servers is prohibited. As well as, the sending of UBE from another service provider advertising a website, email address or the use of any resource hosted on Netwoods servers, is prohibited. NW accounts and services must not be used to solicit clients or collect responses to messages sent from another Internet provider, those messages violate these policies or those of the other provider.
Subscribing email addresses to any mailing list without the express and verifiable permission of the owner of the email address is prohibited. All mailing lists run by Netwoods clients must be through a double opt-in system. The confirmation message received from each email account owner must be kept on file for the duration of the existence of the mailing list. The purchase of email lists from third parties for submissions from any Netwoods hosted domain, or with reference to any Netwoods account, is prohibited. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register or Known Spam Operations (ROKSO) database at www.spamhaus.org is prohibited.
We receive automatic reports from Spamhaus, AOL and SpamCop about our IP ranges. If there are more than three complaints regarding your site in one day, the site will be suspended until a resolution/explanation is made.
Adult Pages - Allowed
Our Servers allow pages of Adult Content that conform to the rules that govern said sites, as long as no minor is mentioned or shown in any case, or reference is made to child pornography. Any site with adult content will be permanently evaluated by NW and will be immediately suspended without compensation if it violates any of our rules or Colombian laws. The restriction of use for people over 18 years of age must be clearly indicated at the beginning of the site.
Any attempt to underestimate, impair or cause harm to a Netwoods server or client is strictly prohibited.
Any NW subnets and dedicated servers must adhere to the above policies. Failure to follow or comply with any of the guidelines creates grounds for account deactivation. We reserve the right to remove any account without prior notice.
NW shared hosting accounts may not be used for the purposes of distributing programs or multimedia products. If you wish to distribute programs and/or multimedia files, please contact sales for a special arrangement.
Media files are defined as any graphic, audio, and video files. Netwoods.com hosting accounts may not be used to store an unusual amount of media files. Any site whose disk space is used for media file storage that exceeds 70% of its total usage, either in terms of total size or number of files, will be charged with using unusual amount of media files.
Any website, on our shared servers that uses a higher amount of server resources (CPU, memory usage and network resources) will be given the option to pay for a dedicated server or VPS. The abuse and misuse of shared system resources is a serious problem. Accounts on a shared server must share resources with other users so we must limit how much CPU and memory space can be used by any one account.
In fairness, we can't allow one or two clients to use all the system resources on a shared machine and let all other clients suffer for it. Excessive CPU and memory usage by one or more clients causes extreme throttling in all other areas: My-SQL, Email, http and more. If CPU and memory usage gets out of hand by some clients, all sites hosted on one machine will fail and will not be accessible in any way.
Memory usage should not exceed 10% per domain/file/application. CPU usage must not exceed 20% per domain/file/application

There are special exceptions to these rules to be determined once we discover abuse. There are different usage combinations that can create problems and other special cases. At any given time that a server is unstable and an account is found to be the cause, we reserve the right to suspend the account to keep the server online and operating normally. If the usage is an increasing trend, we recommend that the user invest in a dedicated server so that the website can grow at a normal rate without restrictions.
These policies are intended to serve as a guide, and are in no way intended to be exhaustive. Acts that violate laws, regulations, or accepted standards in the Internet community, whether or not expressed in these policies, are prohibited.
In the event that your website has been suspended for resource abuse (abuses that cannot be resolved by removing/changing a script, etc.) and you do not wish to upgrade to a dedicated server to accommodate your website's needs, we will only release the suspension within the next 24-48 hours. This is to ensure that the site's CPU slows down the traffic to prevent any future damage and problems. A backup of your files will then be provided and you will not be allowed FTP/cPanel access for a certain period of time.
Give adequate technical management to your hosting or dedicated server service.
The user is totally responsible for the actions that he performs on the files and functions offered by his hosting account and for the consequences that said actions may have. It will be the total responsibility of the contracting user for all the pertinent actions to place the files that constitute their web page in their Hosting, create and maintain email accounts, subdomains, etc. Netwoods is limited to providing the web hosting service without being involved in the content of the hosting account.
In the case of special content of any kind, such as online radio stations, streaming video broadcasts, consultations or modifications of online databases, chats, forums, content managers, in general any software that needs to be installed will be totally It is the client's responsibility to carry out said installations knowing that they must adapt to the technical characteristics of the server and not the other way around, since being a shared server, it cannot be modified to meet the technical needs of particular software.
The user exempts Netwoods, its owners, or its distributors or representatives from all responsibility for legal actions, penalties, losses, compensation, damages, costs, expenses, additional design costs, arrangements, backups, programs, scripts, airtime caused or resulting from direct or indirect failures by the use of our services, to the User or other affected persons without limitation or exception. This responsibility extends to all matters associated with your account including the hosting account domain and Netwoods representatives in the country the company is represented.
The Services are only available to persons who have the legal capacity to contract. If the User acts on behalf of a company, he must have the capacity to contract and bind it under the terms of this Agreement.
By using our hosting services, you agree to our policies. You are expected to use the service in accordance with Colombian law, and always respecting the rights of other Internet users.
It is assumed that the user is aware of the operation of the Internet and is responsible for the proper use of all contracted services.
NW reserves the right to Unilaterally Terminate this Contract at any time if the user of the service addresses the support or sales personnel of the company in an offensive manner at the time of making a claim or support request. Without any type of compensation or return of money or service.
By paying and using our services, the user is fully and unrestrictedly accepting all the terms of this contract. It is the user's responsibility to read these terms carefully before contracting the service.
By using the Service(s), you agree to all terms and conditions of this Agreement, the Uniform Policy (defined below), and any rules, policies, or agreements published in association with specific services that may be enforced by ICANN, enom, Netwoods and both the Colombian national and international governments that have some relationship with the regulations of domain names.
Netwoods may terminate or suspend the Service(s) at any time for cause, including, without limitation, the registration of prohibited domain name(s), abuse of the Services, serious wrongdoing, allegations of illegal conduct, or if use of the Services is in violation of any Internet Service Provider's ("ISP") terms of use acceptable use policies, including the transmission of unsolicited email. Without any kind of restitution or compensation.
EXPIRATION AND RENEWAL OF SERVICE: You acknowledge that it is your responsibility to maintain your own records and to keep track of when your domain name registration expires. As a convenience to you, and not as a binding commitment, we will notify you via email of the need to renew your service. In the event of not carrying out the renewal in a timely manner, all responsibility of Netwoods for said domain name ceases immediately, as well as all responsibility to provide support or advice to said user for the domain that has expired.
The USER releases NETWOODS (GRUPO NW) from any responsibility or obligation regarding Services whose validity has ended. The tolerance of NETWOODS (NW GROUP) to keep a service active once its duration has ended, or the possibility of renewing a Service once its validity has ended, does not imply any responsibility on the part of NETWOODS (NW GROUP) regarding the Services for outside of its validity period.
VERACITY OF THE INFORMATION: By completing the service request form and payment report, whether sent via the Internet or physically, the user agrees to provide accurate information. Said information will be associated with the owner of the domain and solely responsible for any legal or criminal action that is brought against him for improper use of the domain that he registers in his name. If the user represents a third party, she is acknowledging that she has the third party's full consent to use her name and represent him.
TRANSFERS: You agree that the transfer of your domain name (will be governed by ICANN's transfer policy, available at http://www.icann.org/transfers/
Netwoods uses the services of a major domain registrar, if deemed necessary Netwoods reserves the right to transfer the domains under its responsibility to another registrar without prior notice or consent from the owner.
You ACKNOWLEDGE that YOU ASSUME ALL RISK FOR FAILURE OF A TRANSFER IF THE TRANSFER IS INITIATIVE CLOSE TO THE EXPIRATION PERIOD OF THE DOMAIN.
OTHER TERMS OF THE AGREEMENT: The previous text exposes some of the most relevant clauses of the contract, however the entire contract includes each and every one of the clauses exposed in https://www.enom.com/terms/agreement.asp. Payment Policies
The hosting service must be paid at least 5 business days prior to its expiration, otherwise the account will be suspended. Suspended accounts may be reactivated within 48 hours after the suspension without incurring additional charges. In case of not paying the corresponding renewal within 7 days, all the information will be d from our servers.
The monthly dedicated server service must be paid in arrears and send notification of payment with consignment or transfer number, otherwise your payment will not be reflected, otherwise the corresponding payment will not be made, the account will be suspended. Suspended accounts may be reactivated within 48 hours after the suspension without incurring additional charges. In case of not paying the corresponding renewal within 7 days, all the information will be d from our servers. The renewal of the domains must be paid with a minimum of 10 business days prior to its expiration, otherwise the domain will be irretrievably lost.
Netwoods reserves the right to change the prices of services at any time and without prior notice. As well as to modify the payment policies without prior notice.
Netwoods reserves the right to Suspend or Terminate this contract for failure to pay for the service.
Migration of hosting accounts, applications, etc.
Netwoods reserves the right to migrate the accounts to hosting partially or totally to another DATACENTER if it deems it necessary, for which it will request the collaboration of the represented user in an d backup of its website, download of its email accounts to local positions and permission to the DNS of your domain. In the event that the user refuses to provide their collaboration or is not in a position to do so, their contract will NOT be renewed for the following period.
Netwoods reserves the right to unilaterally modify the General Terms and Conditions at any time and without prior notice. It will be understood that the Terms have been modified with the single publication on the Site: http://www.netwoods.net/ of the modifications made to the Terms, the User may express his disagreement with the new terms of service during the 7 days following the date of publication to terminate the contract, otherwise his acceptance will be understood.
The user will be responsible for periodically reviewing the General Terms and Conditions.
When Netwoods becomes aware of a violation of its Usage Policies, an investigation will be launched. During the investigation, the service to the User may be restricted to prevent any further unauthorized activity. Depending on the severity of the violation, Netwoods may restrict, suspend, or terminate the User's account and/or use other civil means. If such violation is a criminal offense, Netwoods will notify the appropriate law enforcement authority of such violation.
ANY VIOLATION OF THE CONTENT RESTRICTIONS WILL BE CAUSE FOR FINAL SUSPENSION OF THE ACCOUNT WITHOUT REFUND OF MONEY OR INDEMNIFICATION OF ANY KIND
Netwoods reserves the right to Unilaterally Terminate this Agreement at any time when it considers that the service has been used inappropriately or there is a violation of the terms of service by the User. There will be no refund of any sum of money proportional to the service not provided for Users whose service contract has been terminated for violation of the Terms of Service.
